1. Introduction
This Privacy Policy explains how TQ Global VOF, operating under the brand name MyVitally ("MyVitally," "we," "us," or "our"), collects, uses, discloses, and protects the personal data of visitors and customers who use our website and services (the "Service"). We respect your privacy and are committed to handling your personal data responsibly and transparently — this is a core part of who we are as a brand.
By using the Service, you agree to the collection and use of information in accordance with this Policy. If you do not agree with this Policy, please do not use the Service.
This Policy is written in English. To the extent any translated version conflicts with the English version, the English version shall control.
2. Children's Privacy
Our Service is not directed to, and we do not knowingly collect personal data from, individuals under the age of 18. If we become aware that we have collected personal data from a child without verification of parental consent, we will take steps to delete that information. If you believe a child has provided us with personal data, please contact us at support@myvitally.com.
3. Information We Collect
Information you provide directly, such as when you place an order, create an account, contact customer support, subscribe to our newsletter, or leave a product review:
- Full name
- Shipping and billing address
- Email address
- Phone number
- Payment information (processed securely by our payment providers — see Section 10)
- Order history and product preferences
- Any information you choose to include in a product review, survey response, or communication with our support team
Information collected automatically, when you visit or interact with our Service:
- IP address and approximate location
- Device and browser information
- Pages viewed, time spent, and browsing behavior on our site
- Cookie and tracking data (see Section 9)
Information about health or wellness experiences. We do not require you to share any health or medical information with us. However, because MyVitally products relate to hormonal health, you may choose to voluntarily share health-related information — for example, in a product review or in a message to our support team. Where you do so, we treat this as sensitive information, use it only for the purpose you shared it (such as publishing your review or responding to your query), and do not use it to infer additional characteristics about you. You may withdraw this information at any time by contacting support@myvitally.com.
4. How We Use Your Information
We use your information to:
- Process and fulfil your orders, including subscription renewals
- Communicate with you about your order, account, or support requests
- Send you marketing communications by email or SMS, where you have opted in (see Section 12)
- Personalize your experience and recommend products
- Improve our Service, products, and customer experience
- Detect and prevent fraud
- Comply with our legal obligations
5. Legal Basis for Processing (EU/UK Residents)
If you are located in the European Economic Area or the United Kingdom, we rely on the following legal bases to process your personal data:
- Performance of a contract — to process and ship your order or manage your subscription
- Consent — for marketing emails, SMS messages, and non-essential cookies, which you may withdraw at any time
- Legitimate interests — to improve our Service, prevent fraud, and operate our business, balanced against your rights and interests
- Legal obligation — where we are required to retain or disclose information by law (for example, tax or accounting records)
6. Sharing Your Information
We do not sell your personal data. We share your information only with:
- Service providers who help us operate our business, such as our e-commerce platform (Shopify), our payment processor (Shopify Payments), our subscription management provider, our email and SMS marketing platform, our shipping supplier, and customer support tools. These providers are only permitted to use your data to perform services on our behalf.
- Advertising and analytics partners, such as Meta and Google, to help us understand how our Service is used and to show relevant advertising. Depending on your location, this activity may be considered a "sale" or "sharing" of personal information under certain privacy laws (see Section 11) — you can opt out at any time.
- Legal and safety purposes, where required to comply with the law, respond to legal process, or protect the rights, property, or safety of MyVitally, our customers, or others.
- A new owner, in the event of a merger, acquisition, or sale of all or part of our business, subject to this Policy or its successor.
7. International Data Transfers
Because MyVitally serves customers across the United States, United Kingdom, Canada, Australia, and New Zealand, and works with suppliers and service providers based in different countries (including China, for order fulfilment), your personal data may be transferred to and processed in countries other than your own. Where we transfer personal data out of the EU/UK, we rely on appropriate safeguards recognized under applicable law, such as Standard Contractual Clauses, to protect your information.
8. Data Retention
We retain your personal data only for as long as necessary to fulfil the purposes described in this Policy, including to satisfy any legal, accounting, or reporting requirements. When your information is no longer needed, we securely delete or anonymize it.
9. Cookies and Tracking Technologies
We use cookies and similar technologies (such as pixels and web beacons) to operate our Service, remember your preferences, understand how visitors use our site, and deliver relevant advertising. You can manage or disable cookies through your browser settings; please note that disabling certain cookies may affect the functionality of the Service. Where required by law, we will ask for your consent before placing non-essential cookies.
10. Data Security
We follow generally accepted industry standards to protect your personal data, both during transmission and once received. Our store is hosted on Shopify, which stores your data on secure servers and encrypts payment information in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we take reasonable steps to protect your information from unauthorized access, loss, or misuse.
11. Your Privacy Rights
Depending on where you live, you have certain rights over your personal data. To exercise any of the rights below, contact us at support@myvitally.com. We may need to verify your identity before completing your request.
If you are in the EU or UK (GDPR / UK GDPR): You have the right to access, correct, or delete your personal data; restrict or object to our processing of it; request data portability; and withdraw consent at any time. You also have the right to lodge a complaint with your local data protection authority — for example, the Dutch Autoriteit Persoonsgegevens or the UK Information Commissioner's Office (ICO).
If you are a US resident: Depending on your state of residence, you may have the right to know what personal information we collect and how we use and share it; correct inaccurate information; delete your personal information; opt out of the sale or sharing of your personal information or its use for targeted advertising; and not be discriminated against for exercising these rights. You can submit a request or opt out at any time by emailing support@myvitally.com.
If you are in Canada (PIPEDA): You have the right to access and correct your personal information and to withdraw your consent to its collection, use, or disclosure, subject to legal or contractual restrictions.
If you are in Australia (Privacy Act 1988): You have the right to access and correct your personal information. If you believe we have not handled your personal information in accordance with the Australian Privacy Principles, you may lodge a complaint with us or with the Office of the Australian Information Commissioner (OAIC).
If you are in New Zealand (Privacy Act 2020): You have the right to access and request correction of your personal information. If you believe your rights have been breached, you may lodge a complaint with the Office of the Privacy Commissioner.
We will not discriminate against you — for example, by denying goods or services or charging different prices — because you exercised any of your privacy rights.
12. Marketing Communications
With your consent, we may send you marketing emails and SMS messages about our products, promotions, and updates. You can opt out of marketing emails at any time using the unsubscribe link at the bottom of any email, and opt out of SMS messages by replying STOP (see Section 9 of our Terms of Service for full details on our SMS program). Opting out of marketing communications does not affect transactional messages related to your order.
13. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated Policy on this page and, where appropriate, by email. Your continued use of the Service after such changes constitutes your acceptance of the updated Policy.
